These Terms of Use ("Terms") apply to the Kardin app for iPhone (the "app"), the pass-signing service it uses, and this website, provided by the Kardin team ("we", "us"). By downloading or using the app you agree to them. If you don't agree, please don't use the app.
1. The licence
The app is licensed to you under Apple's Standard Licensed Application End User License Agreement (the "Standard EULA"); these Terms add to it. We grant you a personal, non-exclusive, non-transferable licence to use the app on Apple devices you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. Where these Terms and the Standard EULA differ on the licence itself, the Standard EULA prevails.
You may not copy, modify, reverse-engineer (except where the law allows it), resell or redistribute the app, or use the pass-signing service other than through the app.
2. Your tickets, cards and passes
Your tickets, cards and the passes you make stay yours; we claim no rights to them. The app reads your files on your iPhone and creates passes from what you review and confirm.
- Check every pass before you rely on it. The app reads barcodes and text automatically, and it can miss or misread details. You're responsible for checking the review screen, and for keeping the original ticket or card until you've confirmed the pass works.
- A pass isn't a guarantee of entry. Venues, airlines, rail companies, stores and other organisers decide what they accept. Some require their own app, the original ticket, or an ID check, and some scanners don't read re-encoded barcodes. A pass made with Kardin carries the same barcode and details as your original, nothing more.
- Passes don't update. Gate changes, delays, cancellations and other changes are not reflected in your pass; check with the organiser.
3. Acceptable use
Only make passes from tickets, cards and bookings that are yours to use, or that you're allowed to carry for someone else. You agree not to use the app or the pass-signing service to:
- copy, duplicate or alter tickets to get entry, services or goods you're not entitled to, or to get around an organiser's ticket rules;
- create passes that imitate official identity documents, payment cards or another company's own passes in a way meant to mislead;
- store bank card numbers, PINs, passwords or bank security codes in a pass;
- send the service anything unlawful, or try to overload, probe or misuse it.
We may limit or block access to the pass-signing service to stop abuse.
4. Price and purchases
Any price and any in-app purchase is shown in the App Store and in the app before you buy, in your local currency, and handled by Apple through your Apple ID. Refunds are handled by Apple under its policies; request one at reportaproblem.apple.com. We can't issue refunds directly.
5. The pass-signing service
Creating a pass needs an internet connection, because Apple requires passes to be signed on a server. We aim to keep the service available but don't guarantee it will always be; passes you've already added keep working in Apple Wallet regardless, offline too. We may change or end the service, and if we end it, the app will no longer be able to create new passes.
6. Support and maintenance
We, not Apple, are solely responsible for providing maintenance and support for the app, as described on our support page or by email at support@kardin.app.
You also agree to comply with any third-party terms that apply when you use the app, such as your mobile carrier's terms for data use.
7. Disclaimer
The app and the service are provided "as is" and "as available". To the fullest extent the law allows we make no warranties, express or implied, including fitness for a particular purpose, and we don't guarantee that the app or the service will be uninterrupted or error-free, that extraction will be accurate, or that any pass will be accepted. Nothing in these Terms limits rights you have as a consumer that can't be limited by contract.
8. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental or consequential damages, including missed flights, trains or events, refused entry, or details misread from a ticket. Our total liability for any claim relating to the app is limited to the amount you paid for it in the 12 months before the claim. Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that can't be limited by law.
9. Apple
These Terms are between you and us, not Apple. Apple is not responsible for the app or its content, and has no obligation to provide maintenance or support for it. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation regarding the app. Apple is not responsible for any claims relating to the app or your use of it, including product liability claims, claims that the app fails to meet legal or regulatory requirements, and consumer protection or privacy claims. If a third party claims that the app infringes its intellectual property, we, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim. You confirm that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting", and that you are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Apple, Apple Wallet and iPhone are trademarks of Apple Inc. Kardin is not made, sponsored or endorsed by Apple, or by any airline, rail company, venue or store whose tickets or cards you use with it.
10. Changes and termination
We may update these Terms; we'll change the date above and, for meaningful changes, mention them in the app's release notes. Continuing to use the app after an update means you accept it. You can stop using the app at any time by deleting it. The licence ends automatically if you breach these Terms.
11. Your rights as a consumer
Nothing in these Terms limits the mandatory consumer protections of the country where you live, including your right to bring a claim before its courts.
12. Contact
